Terms & Conditions

Hiking Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement:

In consideration of the services of the Grasp the Adventure, their guides, owners, volunteers, participants, and all other persons or entities acting in any capacity on the behalf (hereinafter collectively referred to as “AO”), I hereby agree and release and discharge AO on behalf of myself, my children, my heirs, my assigns, personal representative and estate as follows:

 

By agreeing to this page, you hereby affirm and acknowledge that you have been fully informed of the inherent hazards and risks associated with upcoming hike and related activities, not excluding traveling to and from the activity site. You are also aware that the hike leader and guides do not hold current trail guide qualifications, therefore you are participating at your own risk.

 

I acknowledge that trekking, hiking, backpacking, canyoning, climbing, camping and all mountain related sports activities entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

 

The hazards and risks include but are not limited to: 

 

  1. Risk of injury from the activity, including the potential for permanent disability and death. 

  2. Falling, causing broken bones, severe injuries to, but not limited to, the head, neck and back which may result in severe impairment or even death. 

  3. The risk of altitude or cold including hypothermia, acute mountain sickness, cerebral and pulmonary edema,

  4. Hazards from walking on uneven terrain, slips and falls; being struck by a rock fall, or other dislodged objects

  5. All “acts of nature’ including but not limited to, lightning, rock fall, inclement weather, severe wind or any other weather condition which are outside of our control

  6. Your own negligence and/or the negligence of others including, hike leaders and peers. 

  7. Attack by animals, insect’s or reptiles.

  8. Fatigue and/or dizziness which may diminish your reaction time and increase risk of accident.

  9. My own physical condition and the physical exertion associated with this activity

 

You understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness or death.

 

I acknowledge that ‘Grasp the Adventure’ and those acquainted are NOT facilitating as a licensed company nor guiding association.  I am aware that any/all monetary contributions are for the purpose of logistics and photography ONLY. 

 

I hereby release and hold harmless with respect to any and all injury, disability, death or loss or damage to person or property, whether caused by negligence or otherwise, the following named persons, herein referred to as ‘Grasp The Adventure’.  

 

This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforced.

*Logistics include but are not limited to scheduling, planning, route selection and confirmation of event*

Cancelation and Refund Policy: 

Cancellation:

At Grasp the Adventure we understand that sometimes cancelations are beyond your control, that’s why we accept any cancellations for up to 3 days before the event. This way we can ensure that your spot is filled by another member of our energetic community. 

 

Refunds: 

For those that cancel their attendance 3 days before the event, our team will process their refund minus 5% due to processing fees, within 72 hours.

 

No refunds will be processed for cancellations after the 3 day grace period prior to the adventure.  

We ask you to keep that in mind when unsure of your availability on the day of the hike.
