Terms & Conditions

Activity Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement:

Please read and be certain you understand the implications before confirming your participation.

In consideration of the services of Grasp the Adventure LLC and their employees, I hereby agree and release and discharge Grasp the Adventure LLC and their employees on behalf of myself, my children, my heirs, my assigns, personal representative and estate as follows:

 

By agreeing to this page, you hereby affirm and acknowledge that you have been fully informed of the inherent hazards and risks associated with upcoming adventure and related activities, not excluding traveling to and from the activity site. You are also aware that the activity leader and guides do not hold current trail guide qualifications, therefore you are participating at your own risk.

 

I acknowledge that trekking, hiking, backpacking, canyoning, climbing, camping and all mountain related sports activities entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

 

The hazards and risks include but are not limited to: 

 

  1. Risk of injury from the activity, including the potential for permanent disability and death

  2. Falling, causing broken bones, severe injuries to, but not limited to, the head, neck and back which may result in severe impairment or even death

  3. The risk of altitude or cold including hypothermia, acute mountain sickness, cerebral and pulmonary edema,

  4. Hazards from walking on uneven terrain, slips and falls; being struck by a rock fall, other dislodged objects, or even falling people

  5. Equipment may fail. Climbing equipment is tested before use and is designed to hold forces beyond common usage; however, the extreme conditions of the environment in which climbing equipment is used in conjunction with the damages caused by the rock can cause climbing equipment to fail

  6. During mountain climbing, you may cut your hands/fingers on sharp rocks and may experience rope burns when handling your climbing rope

  7. All “acts of nature’ including but not limited to, lightning, rock fall, inclement weather, severe wind or any other weather condition which are outside of our control

  8. Your own negligence and/or the negligence of others including, activity leaders and peers. 

  9. Attack by animals, insect’s or reptiles

  10. Head exhaustion and heat strokes

  11. Fatigue and/or dizziness which may diminish your reaction time and increase risk of accident.

  12. My own physical condition and the physical exertion associated with this activity

 

You understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness or death.

You also affirm and acknowledge your role in preventing injury to yourself and/or to others by following all instructions given by Grasp the Adventure LLC and their employees and by adhering to the following at all times during the event:

​

  1. DO NOT wander off the trail without first getting approval from Grasp the Adventure LLC and their employees

  2. DO NOT go ahead of the Lead Hiking Guide at any time during the event

  3. DO NOT fall behind the Hike Sweeper at any time during the event

  4. DO NOT stop without notifying any of Grasp the Adventure LLC and their employees

  5. DO NOT start the event with less water than was instructed by Grasp the Adventure LLC and their employees

  6. DO NOT rest your body or any of your body parts on rocks, ground, plants or any other element of nature without first checking that it is free from any animals, insects or reptiles

You understand that these rules reduce the risk of injury and/or death but do not eliminate all risks. You also understand that Grasp the Adventure LLC and their employees will instruct of event specific rules at the beginning of each event during their Safety Briefing. You affirm and acknowledge that you have attended, listened to and understood the Safety Briefing.

 

I hereby release and hold harmless with respect to any and all injury, disability, death or loss or damage to person or property, whether caused by negligence or otherwise, Grasp the Adventure LLC and their employees.

This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforced.

 

*I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP ALL LEGAL RIGHTS BY AGREEING TO IT, AND I AGREE FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT *

Cancelation and Refund Policy: 

​

Hiking and Move Night Event Cancellation & Refunds:

At Grasp the Adventure we understand that sometimes cancelations are beyond your control, that’s why we accept any cancellations for up to 72 hours before any hiking and movie night events. This way we can ensure that your spot is filled by another member of our energetic community. 

​

In case of cancellation more than 72 hours before the event, our team will process the refund minus 5% due to processing fees, within 72 hours.

 

No refunds will be processed for cancellations within 72 hours of the adventure.  

We ask you to keep that in mind when unsure of your availability on the day of the hike. 

​

Mountain Climbing Courses & Events Cancellation & Refunds:

15 days before the adventure: 95% Refund

Between 7-15 days before the adventure: 50% Refund

Less than 7 days before the adventure: 0% Refund
